FORCE MAJEURE  

Should there be any circumstances beyond control of Dr. Ajay Shesh like but not limited to Act of God, Act or direction or order of Government in its Sovereign capacity, natural calamity, pandemic, failure of Electric supply or internet services etc. then Dr. Ajay Shesh shall be allowed proportionate extension of time for performing their obligations and Dr. Ajay Shesh will not be responsible for any loss to Client on account of such circumstance.      

PRICING POLICY  

Price of every chargeable product/service will be written on the relevant page and will be mentioned clearly during the training program/video. The gst status of the price as per indian laws will also be mentioned, or the price can be deemed to be inclusive of the gst amount. For every purchase, we will provide you the relevant gst invoice as per indian law after receiving from you the necessary information relevant to the invoice.        

REFUND AND CANCELLATION POLICY  

We know that long documents written in legalese can be boring and confusing, so here’s a quick summary of the key points. Just be aware that the full text of the Terms and Policies is what applies to your order, not the following summary.

These quick bullet points are provided solely for your convenience.  

1. All payments made are final; there are no refunds, exchanges, or cancellations except in point No. [3] below.
2.     If an event is postponed, your payment will be valid for the date of the postponement. (No refunds are issued for postponed events.)
3.     If an event is cancelled, you will be refunded the amount received by us. Refund will be initiated from us to credit your bank account within 5-7 working days.
4. We are not responsible for any other loss e.g., any travel expenses, any personal or uncontrollable situations caused by third parties and/or weather which prevents your event attendance, any loss of opportunity etc.
5. We are not responsible for the programme/course/seminar/discussions/webinar being/becoming impaired for whatever reason due to electricity failure or any other reason for which we are not responsible. Therefore, no refund will be provided
6. If, at the start itself there is a power failure or for any reason the programme/course/seminar/discussions/webinar is not able to be conducted, then in that event, such participants will be accommodated on any future date as we may conduct the next programme/course/seminar/discussions/webinar.  If on that day the person who missed attending the programme/course/seminar/discussions/webinar due to power failure or for some reason due to which we were not able to conduct the programme/course/seminar/discussions/webinar, does not/is not able to attend, there will be no refund of the fees paid and such person will not be accommodated in future programme/course/seminar/discussions/webinar without fresh payment of fees.  

JURISDICTION CLAUSE  

USER agrees that any controversy or claim arising out of or relating to the use of SITE will be governed by the laws of India without regard to its conflict of law provisions. USER agrees to exclusive Jurisdiction of Courts at Korba, to the exclusion of any other court.      

POSH DISCLAIMERS  

USER have a personal responsibility to ensure that their behaviour is not contrary to this policy. All USER are encouraged to reinforce the maintenance of an environment free from sexual harassment.      

NO LIABILITY FOR 3RD PARTY ACTIONS  

We accept no liability to third parties for damages of any kind, regardless of the cause, unless the damages are due to intention or gross negligence of ours.   The Client shall safeguard us from claims made by third parties following the execution of this agreement.      

DO’S & DON’TS FOR EXTERNAL GUESTS AND SPEAKERS  

1.The speaker should not discuss anything controversial. Should not comment on any political matter, religion, race, caste, unwelcomed sarcasm, cynicism etc. (If the speaker doesn’t say anything controversial and then also someone sues the speaker, then Dr. Ajay Shesh will take care of that issue.)

2. The speaker shall behave in ethical and civil manner.
3. The speaker should notify of any delays or any other issue to the foundation.
4. The speaker shall respect the confidentiality of the business or client.      

CODE OF CONDUCT FOR THE PARTICIPANTS  

1. The participants should show courtesy, consideration and respect for each other.
2. Avoid using obscene, abusive or offensive language.
3. Show respect for diversity and not disrespect, vilify or belittle any other person.
4. Do Not consume alcohol and do not smoke during the event.
5. Act with integrity and refrain from dishonest behaviour.
6. Maintain and develop professional relationships with other participants.
7. Participant should not intimidate, harass or stalk any person.      

DISCLAIMER STATEMENT ON VIDEOS  

Under no circumstances will Dr. Ajay Shesh be responsible or liable in any way and for any content, including but not limited to, any errors or omission in the content, or for any loss or damage of any kind incurred as a result of any content communicated in this video, whether by us or a third party. In no event shall be Dr. Ajay Shesh liable for any special, indirect, consequential damages or any damages whatsoever resulting from loss of use, data, or profits arising out of or in connection with the availability use or performance of any information communicated in this video.

Place yourself in a well-lit area with the light coming from in front of you and not behind you.   Test your computer equipment, camera, microphone and speakers ahead of time. Check your internet stability with your provider Ensure you have the Virtual event access link in advance Tell your family, clear your potential distractions ahead of time to ensure you have dedicated focus at the event Have a notebook to take notes and jot down your list of questions Be Respectful to your fellow attendees Turn on your camera. You are on Video! Follow the Dress code of the event properly      

PLEASE DO NOT DO ANY OF THE FOLLOWING:    

Take screenshots or record audio/video. Ask or solicit the Speakers or fellow attendees to follow you on social media or contact you after the event. Ask the speakers anything you would not ask a friend. Violate the Virtual Events Experience Acceptable Use Policy above The speaker should not discuss anything controversial. Should not comment on any political matter, religion, unwelcomed sarcasm, cynicism etc.      

CLAUSE FOR LEGAL IMMUNITY FOR DR. AJAY SHESH FROM DISPUTES BETWEEN PARTICIPANTS IF THEY DO MUTUAL BUSINESS   – For any dispute arising between the participants due to their mutual business, Dr. Ajay Shesh will not be liable for any such disputes.      

INTELLECTUAL PROPERTY INFORMATION  

For purposes of these TERMS, ‘CONTENT’ is defined as any information, communications, software, photos, video, graphics, music, sounds, and other material and services that can be viewed by USERS on the site and at the event. This includes, but is in no way limited to, message boards, chat, and other original content.

By accepting these TERMS, USER/Speaker acknowledges and agrees that all CONTENT presented to USER on this site and at the event are protected by copyrights, trademarks, service marks, patents or other proprietary intellectual property rights and laws, and is the sole property of SITE/Dr. Ajay Shesh. USER is only permitted to use the CONTENT as expressly authorized in writing by SITE or the specific provider of CONTENT.

USER/Speaker may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any documents or information from this site and at the event in any form or by any means without prior written permission from SITE/Dr. Ajay Shesh or the specific CONTENT provider, and USER is solely responsible for obtaining permission before reusing any copyrighted material that is available on this site and at the event.

Any unauthorized use of the materials appearing on this site and at the event may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. After proper notification by the copyright holder or its agent to us, and confirmation through court order or admission by the USER that they have used this SITE or CONTENT at the event as an instrument of unlawful infringement, SITE will terminate the infringing USER’S rights to use and/or access to this SITE. SITE may, also in its sole discretion, decide to terminate a USER’s rights to use or access to the SITE prior to that time if SITE believes that the alleged infringement has occurred. CONTENT provider may reserve the rights to take legal action against the infringing USER/Speaker.
